USPTO fees are paid by you, to the USPTO, at filing. For a provisional application they start at $65 for a micro entity, $130 small, $325 large (USPTO fee schedule as of January 2026) — your package includes the exact estimate with its effective date printed on it. To keep the priority date, a non-provisional must follow within 12 months, typically with a patent attorney; you can hand your package to one directly from the product.
Failed drafting runs are refunded automatically. Cancel anytime from the billing portal. Prices exclude taxes.
